2026 Website Giveaway terms & conditions

The BIOS BOIS New Website Launch Giveaway (“the Giveaway”) is conducted by BIOS BOIS (Pty) Ltd (“BIOS BOIS”, “we”, “us” or “our”), a company registered in the Republic of South Africa.

The Giveaway is being conducted in celebration of the launch of the new BIOS BOIS website and is intended to support selected small businesses by providing professional website design or redesign services.

By entering the Giveaway, an entrant confirms that they have read, understood and agreed to these Terms & Conditions.

Entries open on 15 September 2026 at 00:00 and close on 15 December 2026 at 23:59, South African Standard Time. No entries are accepted before opening or after closing, unless BIOS BOIS publicly extends the entry period in accordance with these Terms & Conditions.

Entries received after the closing date and time will not be considered unless BIOS BOIS has publicly extended the entry period in accordance with these Terms & Conditions.

BIOS BOIS intends to select at least one suitable eligible business during each month of October, November and December 2026, resulting in a minimum of three winning businesses.

At BIOS BOIS's discretion, an additional winner may be selected during any of these months where project scope, project completion times, workload and available capacity reasonably allow. A maximum of two winners may therefore be selected in any one month, resulting in a maximum of six winning businesses during the Giveaway.

Eligible entries that have not already been selected will remain in consideration for subsequent monthly selections until the Giveaway closes. Entries received before the closing time on 15 December 2026 may be considered for the December selection.

The selection of an additional winner in any month is not guaranteed and does not create an obligation for BIOS BOIS to select an additional winner in that or any subsequent month.

Project timing may be adjusted where reasonably necessary due to the scope of a project, delays in receiving information or content from a winner, technical circumstances, availability, or other reasonable operational requirements.

The Giveaway is open to small businesses, start-ups, sole proprietors, entrepreneurs, organisations and other suitable business ventures based in South Africa. 

• The person submitting the entry must:
• • be 18 years of age or older;
  • be the owner of the business or have authority to enter on behalf of the business;
  • provide accurate and truthful information; and
  • be legally capable of accepting these Terms & Conditions on behalf of the business where applicable.
• A business does not need to have an existing website to enter.
• A business does not need to be a registered business to enter.
• Businesses with an existing website may enter for a website redesign or revamp.
• Employees, directors, agents or consultants of BIOS BOIS, persons directly involved in administering the Giveaway, suppliers directly involved in providing the prizes, and any other persons who may legally be prohibited from receiving a prize are not eligible to win.

• No purchase or payment is required to enter.
• To submit a valid entry, an entrant must:
  • Visit the BIOS BOIS website at biosbois.co.za.
  • Complete the official New Website Launch Giveaway entry form.
  • Provide the information requested on the entry form.
  • Tell BIOS BOIS about the business and its website or online-presence needs.
  • Explain how a new website or website revamp could benefit the business.
  • Provide links to an existing website and/or relevant social-media pages where applicable.
  • Accept these Terms & Conditions before submitting the entry.
• BIOS BOIS may also invite entrants to comment on, follow, tag, nominate or share social-media content relating to the Giveaway. Unless expressly stated otherwise, social-media engagement is encouraged but is not required for an entry to be considered.
• The number of likes, comments, followers, shares or nominations received by an entrant will not determine the winners.

Unless BIOS BOIS expressly states otherwise, only one entry per business will be considered.

Duplicate entries may be consolidated or disregarded.

Where more than one person enters the same business, BIOS BOIS may treat those submissions as a single business entry.

BIOS BOIS intends to award a minimum of three website prizes during the Giveaway, subject to receiving sufficient eligible entries that reasonably meet the published selection criteria and project-suitability requirements. BIOS BOIS intends to select at least one winning business during each of October, November and December 2026.

BIOS BOIS may, at its discretion and where workload, project scope and available capacity allow, select one additional winning business during any of those months, up to a maximum of six winning businesses in total.

Each winning business will receive:

• one custom small-business website design OR redesign/revamp;
• a website of up to 10 standard pages; and
• six months of 1GB BIOS BOIS website hosting at no charge.

Businesses requiring a website larger than 10 pages or with requirements beyond the standard prize scope may still enter. BIOS BOIS will determine whether the proposed project can reasonably be accommodated within the Giveaway. Additional pages, features or services outside the prize scope will only be provided if separately agreed in writing and may be subject to additional charges.

The exact website structure, number of pages, design approach and functionality will be agreed between BIOS BOIS and each winner and will remain subject to the scope limitations contained in these Terms & Conditions.

For purposes of this Giveaway, a standard page means a normal informational website page using functionality ordinarily provided as part of a standard small-business website.

Examples may include:

• Home;
• About;
• Services;
• Products or product-information pages;
• Gallery;
• Portfolio;
• FAQ;
• Blog;
• Testimonials; and
• Contact.

BIOS BOIS will determine whether requested pages, features or functionality fall within the standard website scope of the prize.

Unless BIOS BOIS specifically agrees otherwise in writing, the prize does not include:

• e-commerce or online-store functionality;
• complex online booking or reservation systems;
• membership or subscription systems;
• learning-management systems;
• custom web applications;
• bespoke databases;
• customer portals;
• extensive custom programming;
• complex third-party integrations;
• paid plugins;
• paid software licences;
• premium third-party services;
• payment-gateway fees;
• professional photography or videography;
• paid stock imagery;
• extensive copywriting;
• large-scale content migration;
• email hosting unless specifically included;
• domain registration or renewal costs;
• specialist SEO campaigns;
• advertising expenditure; or
• any other specialist functionality or service outside the reasonable scope of a standard small-business website.

BIOS BOIS may, at its discretion, agree to provide additional functionality or services. Where such additional work carries a cost, the winner will be informed of the cost and must approve it before the additional work is undertaken.

A winner is under no obligation to purchase additional services in order to receive the prize within the defined prize scope.

Businesses that may require extra features or functionality can still enter, but BIOS BOIS is not obligated to meet requirements that fall outside the scope of the prize. Where BIOS BOIS agrees to provide additional features, functionality or services outside the prize scope, these may be quoted and charged for separately with the winner's prior approval.

 

 

The prize does not include costs that BIOS BOIS must pay to an external supplier on the winner's behalf unless BIOS BOIS expressly states otherwise.

This includes, without limitation:

• purchasing or registering a domain name;
• renewing a domain name;
• paid software or plugins;
• third-party licences;
• premium services;
• externally supplied stock assets; and
• other third-party charges.

Where a domain name or other paid third-party product is required, the winner will be responsible for that cost.

BIOS BOIS will obtain approval before incurring a charge for which the winner will be responsible.

Each winning website includes six months of 1GB website hosting at no charge.

The six-month free hosting period begins when the winning website goes live, unless BIOS BOIS and the winner agree another start date in writing.

The free hosting is subject to BIOS BOIS's normal hosting terms, reasonable-use requirements and technical limitations.

The hosting prize is limited to 1GB of hosting space unless otherwise agreed.

The winner has the option to continue hosting with BIOS BOIS after the six-month period is up at their own cost. 

There is no obligation for a winner to continue hosting with BIOS BOIS after the six-month free period.

At the end of the free period, the winner may elect to continue hosting with BIOS BOIS.

The current continuation price for the applicable 1GB hosting package is R99 per month.

Hosting prices may change in future. If the applicable price has changed by the time the winner's free hosting period ends, BIOS BOIS will advise the winner of the applicable price before any paid hosting period begins.

No winner will automatically be charged for paid hosting without agreeing to continue with the service.

Where an existing domain name or website needs to be transferred or migrated to BIOS BOIS in order for BIOS BOIS to provide the winning website and/or free hosting, the winner must have the authority to authorise the transfer and must provide the information, authorisation codes, login details and access reasonably required to complete it.

Where available and reasonably practicable, BIOS BOIS may require access to the winner's existing cPanel or hosting account in order to create a backup of the existing website, databases, email-related data and other relevant hosting data before a hosting transfer or migration is performed.

Transfers of .co.za domains can ordinarily be performed without a domain transfer fee. Other domain extensions, registrars or service providers may charge transfer, renewal or administrative fees. Any third-party fee payable in connection with a transfer is not included in the Giveaway prize and will be disclosed to the winner before BIOS BOIS incurs that cost on the winner's behalf.

A domain, DNS or hosting transfer may result in temporary interruption to the website, email or other domain-related services while DNS changes propagate and the transfer or migration is completed. BIOS BOIS will take reasonable care to minimise disruption but cannot guarantee uninterrupted availability during a transfer or DNS change.

The winner remains responsible for ensuring that important email messages and locally stored email data are backed up before any domain, DNS, email or hosting migration. BIOS BOIS cannot guarantee that email data held by third-party email providers, individual devices or software outside the existing hosting account can be backed up or transferred by BIOS BOIS.

A winner who does not wish to transfer their website or hosting to BIOS BOIS may decline the six months of free BIOS BOIS hosting, provided that the alternative hosting environment is reasonably compatible with the website BIOS BOIS is providing. No cash, credit, refund or other compensation will be provided in exchange for declining any part of the hosting prize.

Any additional migration, configuration or technical work required because a winner elects to use a different hosting provider may fall outside the Giveaway prize and may be quoted separately where applicable.

BIOS BOIS may use commercially licensed themes, website builders, plugins, extensions, tools or other software in designing, developing, hosting or maintaining a winning website. These may include software licensed to BIOS BOIS for use on client websites.

Unless expressly agreed otherwise in writing, the Giveaway prize does not transfer ownership of BIOS BOIS's software licences, licence keys, subscriptions, developer or agency accounts, update entitlements or other software-related rights to the winner.

While a winning website is hosted and, where applicable, maintained by BIOS BOIS, BIOS BOIS may activate qualifying software using licences held by BIOS BOIS. Such activation is provided as part of BIOS BOIS's service and does not give the winner or any third party ownership of, access to, or a continuing right to use BIOS BOIS's licence credentials or accounts independently of BIOS BOIS.

If the website is moved away from BIOS BOIS hosting or BIOS BOIS otherwise ceases to provide the service under which a BIOS BOIS software licence is made available, BIOS BOIS may deactivate or remove its licence keys, site registrations, update entitlements and other licence-dependent services from the website where permitted by the applicable software licence.

The winner may be required to purchase and activate their own licence for any software that requires an independent licence in order to continue receiving updates, support, premium services, editing functionality or other licensed features after BIOS BOIS's licence is withdrawn.

Where technically and legally permissible, existing website content and front-end functionality may continue to operate after a BIOS BOIS licence is deactivated. However, BIOS BOIS does not guarantee that all software, editing functionality, updates, support, security updates, integrations or future compatibility will continue without an appropriate active licence.

BIOS BOIS's licence keys, account credentials and other proprietary access information may not be copied, disclosed, transferred or used by the winner, another website designer, developer, hosting provider or any other third party without BIOS BOIS's written permission.

This Giveaway is not a popularity contest.

Winners will not be chosen based simply on the number of likes, followers, shares, comments, nominations or social-media engagement they receive.

The saddest or most difficult story will also not automatically be selected.

BIOS BOIS will assess eligible entries based on factors including:

• the business's genuine need for a website or website improvement;
• the potential positive impact a new website could have on the business;
• the current state of the business's online presence;
• the business and its circumstances;
• whether BIOS BOIS believes it can meaningfully improve the business's online presence;
• the suitability of the requested project for BIOS BOIS's services;
• whether the project can reasonably be completed within the scope of the prize; and
• the overall suitability of the project for the aims of the Giveaway.

These criteria are considered collectively and no single factor necessarily determines the outcome.

BIOS BOIS retains reasonable discretion in evaluating project suitability and selecting the winning businesses it believes best fit the objectives and practical scope of the Giveaway, subject to the minimum and maximum number of prizes described in these Terms & Conditions.

 

Submitting an entry does not guarantee that an entrant will be selected.

BIOS BOIS is under no obligation to provide free website services to unsuccessful entrants.

Where an entrant's desired website falls outside the scope of the prize, BIOS BOIS may determine that the project is unsuitable for the Giveaway.

Selected winners will be contacted using the contact information supplied on their entry form.

A selected winner must respond within five business days of notification unless BIOS BOIS specifies another reasonable period in the notification.

BIOS BOIS may request reasonable information to verify the winner's identity, business, authority to represent the business and eligibility.

If a selected winner:

• cannot be contacted;
• fails to respond within the specified period;
• provides false or misleading information;
• is found to be ineligible;
• refuses the prize;
• cannot reasonably proceed with the project; or
• requires a project that falls materially outside the advertised scope,

BIOS BOIS may withdraw the offer and select another eligible entrant.

BIOS BOIS intends to select at least one winner in each of October, November and December 2026. BIOS BOIS may select one additional winner in any of those months where project scope, completion times, workload and available capacity reasonably allow. Any additional monthly winner is optional and is not guaranteed.

The December selection may take place after entries close on 15 December. Project work may continue into January 2027 or later according to the agreed brief, content readiness and schedule.

The allocation of a particular winner to a particular month will be determined by BIOS BOIS taking into account project readiness, scope and scheduling.

These dates represent the intended project schedule and do not constitute an absolute guarantee that every website will be completed or launched within that calendar month.

Winners must cooperate reasonably with BIOS BOIS during the website project.

Unless otherwise agreed, winners are responsible for supplying BIOS BOIS with the information and materials reasonably required to complete their website, which may include:

• business information;
• logos;
• branding;
• photographs;
• product or service information;
• contact information;
• website text or information needed to prepare website text;
• access to an existing website where a redesign is being performed;
• domain information; and
• other relevant content or access credentials.

The winner is responsible for ensuring that they have the necessary rights, licences or permissions to use any content, photographs, logos, trademarks or other materials supplied by them to BIOS BOIS for inclusion on the website. BIOS BOIS will not be responsible for claims arising from materials supplied by a winner where the winner did not have the necessary rights or permission to use those materials.

Where the prize involves the redesign or modification of an existing website, the winner must have the legal authority and necessary access rights to authorise BIOS BOIS to work on that website and must provide the access reasonably required to perform the work.

BIOS BOIS will not be responsible for delays caused by a winner failing to provide required information, content, approvals or access within a reasonable period.

Where BIOS BOIS is redesigning or modifying an existing website, the winner must ensure that they have retained copies of any website content, text, images, documents, emails or other data that they wish to preserve and must provide BIOS BOIS with any content reasonably required for the new website.

BIOS BOIS may create its own backup of the existing website where the necessary access is available and it is reasonably practicable to do so. However, any backup created by BIOS BOIS is an additional precaution and does not replace the winner's responsibility to retain copies of important content and data.

Where an existing WordPress website is rebuilt using BIOS BOIS's preferred website-building software, including Oxygen, the existing website design, page layouts, templates and/or content structures may not be compatible with the new system and may need to be replaced or recreated. The winner acknowledges that the existing website may therefore be substantially rebuilt rather than simply edited, and that existing layouts or content may not remain available in their previous form.

BIOS BOIS will take reasonable care when working with an existing website but will not be responsible for loss or disruption caused by pre-existing website faults, malware, corrupted data, incompatible themes or software, unsupported or outdated software, third-party hosting problems or other circumstances outside BIOS BOIS's reasonable control, except to the extent that liability cannot lawfully be excluded.

Any passwords, login credentials, access codes or other security information supplied to BIOS BOIS will be used only as reasonably necessary to perform the website, hosting, migration or related services. Winners are encouraged to create temporary credentials where possible and to change relevant passwords after migration or project completion where appropriate. BIOS BOIS will take reasonable measures to protect credentials supplied to it against unauthorised access or disclosure.

The website will be designed in accordance with BIOS BOIS's professional design process.

BIOS BOIS will take reasonable account of the winner's business, branding, preferences and requirements while retaining professional discretion over the design and technical implementation.

The prize is intended to provide a completed professional small-business website and does not include unlimited revisions or indefinite redesign work.

BIOS BOIS may establish reasonable revision limits and project milestones before work begins.

The winner remains responsible for the accuracy and legality of information relating to their business.

The winner warrants that material supplied to BIOS BOIS does not knowingly infringe another person's copyright, trademark, privacy or other rights.

BIOS BOIS may refuse to publish content that it reasonably believes is unlawful, misleading, discriminatory, infringing, harmful or otherwise inappropriate.

Subject to payment of any separately approved third-party or additional charges and any applicable BIOS BOIS service terms, ownership and licensing of the completed website will be dealt with in accordance with BIOS BOIS's standard website-design terms.

Because the website is being created as part of the BIOS BOIS New Website Launch Giveaway, the winner acknowledges that BIOS BOIS may identify the completed project as work designed and/or developed by BIOS BOIS.

BIOS BOIS may display and showcase the completed website and its design in its professional portfolio, website, social-media channels, proposals, presentations, case studies and other materials used to demonstrate BIOS BOIS's work, subject to applicable privacy and other laws.

This may include screenshots of the website, design mock-ups, before-and-after comparisons and a factual description of the website project.

BIOS BOIS may wish to share the story behind a winning business and the impact that the website project may have on that business.

BIOS BOIS may therefore invite a winner to participate in publicity relating to the Giveaway, including:

• a BIOS BOIS case study;
• social-media posts;
• blog articles;
• interviews;
• photographs or video;
• winner announcements;
• before-and-after website features;
• press releases;
• local, regional or national media coverage; and
• other reasonable publicity relating to the Giveaway and the website project.

BIOS BOIS may also approach media organisations with information about the Giveaway, the website project and the winning business, subject to applicable privacy laws and any consent required for personal information.

Where consent is legally required for use of a winner's personal image, personal story, interview, testimonial or participation in marketing, the winner will be given the opportunity to provide or decline that consent.

A winner will not lose the prize merely because they decline optional participation in publicity that legally requires their consent.

BIOS BOIS may still showcase the website project itself to the extent permitted by these Terms & Conditions and applicable law.

Entrants acknowledge that information submitted as part of an entry may be reviewed by BIOS BOIS for the purposes of:

• administering the Giveaway;
• evaluating entries;
• contacting entrants;
• selecting winners;
• verifying eligibility;
• planning winning projects; and
• complying with legal and administrative requirements.

BIOS BOIS will not intentionally publish private or sensitive information contained in an entry merely because the information was supplied as part of the Giveaway.

Where BIOS BOIS wishes to use personal aspects of an entrant's or winner's story publicly, appropriate permission will be obtained where required.

BIOS BOIS will process personal information submitted in connection with the Giveaway in accordance with applicable South African data-protection law, including the Protection of Personal Information Act, 4 of 2013 (“POPIA”).

Personal information may be collected and processed for purposes reasonably connected with the Giveaway, including:

• receiving and administering entries;
• communicating with entrants;
• assessing eligibility;
• selecting and contacting winners;
• administering and delivering prizes;
• maintaining records;
• preventing fraud or abuse; and
• complying with legal obligations.

BIOS BOIS will take reasonable measures to protect personal information against unauthorised access, loss, misuse or disclosure.

Information will not be retained for longer than reasonably necessary except where BIOS BOIS is legally required or entitled to retain records for a longer period.

Entry into the Giveaway does not automatically constitute consent to receive unrelated electronic marketing communications from BIOS BOIS.

Where BIOS BOIS provides entrants with the option to subscribe to newsletters, promotions, special offers or other marketing communications, this consent will be requested separately where required by law.

Declining optional marketing consent will not reduce an entrant's chance of being selected.

Where the entry form includes an optional consent relating to publicity, photographs, interviews, testimonials or the sharing of the entrant's personal story, that consent is separate from acceptance of these Terms & Conditions.

Declining optional publicity consent will not disqualify an otherwise eligible entrant or reduce their chances of selection.

The prize cannot be exchanged for cash, credit or any other cash equivalent.

A winner may not demand payment of the retail or perceived value of any unused portion of the prize.

If a winner does not require a particular included component of the prize, no cash refund or substitution will be payable in respect of that component.

The prize is awarded to the selected business and may not be sold, transferred or assigned to another business or person without prior written approval from BIOS BOIS.

BIOS BOIS may refuse a proposed transfer where the substituted project would materially differ from the project originally selected.

BIOS BOIS may disqualify an entry where there are reasonable grounds to believe that:

• information supplied is false, fraudulent or deliberately misleading;
• the entrant does not own or represent the business entered;
• the entrant is not eligible;
• the entrant has attempted to manipulate the selection process;
• multiple entries have been submitted in an attempt to gain an unfair advantage;
• the entrant has interfered with the Giveaway, website or entry process;
• the proposed business or website involves unlawful activities; or
• participation would otherwise breach these Terms & Conditions or applicable law.

The Giveaway may be promoted through Facebook, Instagram or other social-media platforms.

Unless expressly stated otherwise, the Giveaway is not sponsored, endorsed, administered by, or associated with Meta, Facebook, Instagram or any other third-party social-media platform.

Entrants release such platforms from responsibility for administration of the Giveaway to the extent permitted by law.

Entrants must not impersonate BIOS BOIS or respond to fraudulent accounts claiming that payment is required to receive a prize.

BIOS BOIS will never require a winner to pay BIOS BOIS a fee merely to claim the advertised prize.

Members of the public may be encouraged to tag or nominate businesses they believe could benefit from the Giveaway.

A nomination or tag does not automatically enter that business into the Giveaway unless BIOS BOIS expressly states otherwise.

The nominated business may still be required to submit the official entry form and accept these Terms & Conditions.

The number of nominations a business receives does not determine whether it will be selected.

BIOS BOIS intends to conduct the Giveaway in accordance with these published Terms & Conditions.

BIOS BOIS may amend, suspend, postpone or cancel the Giveaway where reasonably necessary due to circumstances beyond its reasonable control, legal or regulatory requirements, fraud, security concerns, technical failure, platform failure or circumstances that prevent the Giveaway from being conducted fairly or substantially as intended.

BIOS BOIS will not materially alter the Giveaway merely to avoid awarding an advertised prize.

If, despite receiving entries, there are insufficient eligible entries that reasonably meet the published project-suitability criteria, BIOS BOIS will not be required to select an unsuitable or ineligible project merely to reach the intended number of winners. BIOS BOIS will document the reason and communicate any resulting change through the Giveaway page and/or promotional channels.

Where reasonably possible, any material change affecting entrants will be communicated through the BIOS BOIS website and/or the same channels used to promote the Giveaway.

BIOS BOIS is not responsible for entries that are not successfully received due to internet outages, device failure, website interruption, corrupted submissions or other technical problems beyond its reasonable control.

Where BIOS BOIS becomes aware of a material technical problem affecting entries, reasonable steps will be taken to correct the problem and, where appropriate, provide affected entrants with another reasonable opportunity to enter.

Nothing in these Terms & Conditions is intended to exclude or limit any right or remedy that cannot lawfully be excluded under South African law.

Subject to that qualification, BIOS BOIS will not be liable for indirect or consequential loss arising solely from participation in the Giveaway or circumstances beyond BIOS BOIS's reasonable control.

A winning website may rely on third-party services, platforms, software, domain registrars, plugins or infrastructure.

BIOS BOIS cannot guarantee the continued operation, pricing, availability or policies of independent third-party providers.

Where an optional third-party service involves a cost, that cost will be disclosed to the winner before the winner is committed to it.

Selection is based partly on the information supplied in the entry.

If, after selection, BIOS BOIS discovers that the actual project requirements differ materially from the information supplied and fall outside the advertised prize scope, BIOS BOIS will first attempt to agree with the winner on a suitable website that falls within the prize scope.

If no reasonable in-scope project can be agreed upon, BIOS BOIS may withdraw the award and select another eligible business or the winner may elect to pay for the extra work for their specific requirements.

This provision may not be used merely because BIOS BOIS subsequently prefers another entrant.

If a winner repeatedly fails to supply necessary content, information, access or approvals after reasonable requests and reasonable time has been allowed, BIOS BOIS may place the project on hold.

If the winner remains unable or unwilling to proceed after reasonable notice, BIOS BOIS may regard the prize as forfeited and may, where appropriate, select another eligible entrant.

BIOS BOIS will announce confirmed winners and material Giveaway updates on its Facebook and Instagram pages and/or on the Giveaway page of the BIOS BOIS website. Entrants are welcome to follow BIOS BOIS on social media to receive these updates, but following BIOS BOIS on social media is not a condition of entry or selection.

BIOS BOIS may publicly announce the name of a winning business after the winner has been contacted and eligibility has been confirmed.

Where an announcement would include the personal name, photograph or other personal information of an individual associated with the business, BIOS BOIS will comply with applicable privacy and publicity requirements.

After each selected business has been contacted and eligibility confirmed, BIOS BOIS plans to announce the confirmed business name on the Giveaway page of biosbois.co.za. Entrants who are not selected will not necessarily receive individual notices. Any personal information in an announcement remains subject to the privacy and publicity provisions above.

BIOS BOIS will retain such records relating to the Giveaway as are reasonably necessary and/or required by applicable South African law.

These may include the Giveaway rules, promotional material, entries, winner-selection records, prize information and records confirming delivery of prizes.
